General Terms and Conditions (GTC)

(1) These General Terms and Conditions (GTC) apply to all contracts for cleaning, maintenance, and service work concluded between Unterhaltsservice Adam (hereinafter "Contractor") and its customers (hereinafter "Client"). (2) The GTC apply to all services provided in the areas of gastronomy & hospitality, office & commercial spaces, as well as house & apartment cleaning, and also cover general maintenance and service work on and in the property (e.g., gardening, minor repairs). (3) Deviating, conflicting, or supplementary GTC of the Client shall not become part of the contract, even if known, unless their validity is expressly agreed to in writing by the Contractor.

(1) The Contractor’s offers are non-binding and without obligation. A contract is only concluded upon written order confirmation by the Contractor or by the performance of the service. (2) The scope of services to be provided as well as the frequency of the work are specified in the individual offer or in the order confirmation. (3) The Client is obliged to grant the Contractor free access to the premises to be cleaned or serviced. All surfaces to be cleaned, dusted, or treated must be freely accessible. (4) Cleaning under objects (e.g., furniture, machines) will only be carried out if they are easily movable and accessible. Otherwise, the area shall be deemed inaccessible. (5) Work on objects located at a height of more than 2.50 meters is considered an additional service and will be charged separately based on effort, unless otherwise agreed in the offer or order in writing.

(1) The prices agreed in the offer apply. Since Unterhaltsservice Adam is currently not subject to VAT as a sole proprietorship, the prices do not include VAT. (2) Invoices are due after the service has been rendered. If payment is received within two (2) working days of the invoice date, the Contractor grants a 5% discount, unless otherwise agreed in writing. (3) In case of default in payment, the Contractor reserves the right to charge default interest and reminder fees in accordance with legal provisions.

(1) The Contractor offers the option of emergency cleaning outside regular working hours. (2) For emergency cleaning carried out between 5:00 a.m. and 8:00 a.m., the following additional costs apply: a) A one-time on-call fee of CHF 185. b) Costs per time slot of CHF 95. c) Travel costs are charged per trip and are based on the rates specified in the offer per kilometer driven. (3) Emergency cleaning must be ordered separately and will be confirmed in the individual emergency offer.

(1) The Client must inspect the work immediately after completion. Obvious defects must be reported to the Contractor without delay, at the latest within 24 hours, in writing. (2) In the case of timely and justified complaints, the Contractor has the right to rectify the defect free of charge. Further claims, in particular for reduction or damages, are excluded to the extent permitted by law. (3) In the case of hidden defects discovered later, the complaint must be made without delay after discovery, but no later than 7 days after completion of the work, in writing.

(1) The Contractor is only liable for damages demonstrably and directly caused by its employees or due to gross negligence. (2) Liability is limited to typical, foreseeable damages under the contract. (3) The Contractor assumes no liability for damages caused by tools, materials, or chemicals provided by the Client. (4) The Contractor is obliged to maintain business liability insurance and to provide a copy of the policy upon request.

(1) Contracts for recurring services may be terminated by either party with a written notice period of 30 days to the end of the month. (2) Termination for good cause remains unaffected. Good cause exists if the continuation of the contractual relationship until the expiry of the notice period is unreasonable for one party.

(1) The Contractor undertakes to comply with statutory data protection regulations. Personal data will be collected, processed, and used exclusively for the purpose of contract execution and fulfillment.

(1) Should individual provisions of these GTC be invalid or become invalid, the validity of the remaining provisions shall not be affected. (2) The place of jurisdiction is the Contractor’s registered office. Swiss law applies.
